These Terms of Service govern your access to and use of the website sermentcouture.com and everything we offer through it (the “Services”). The terms “we”, “us” and “our” refer to Arshad Trade - F.Z.E, trading as Serment Couture, Office C1 – 1F – SF7756, Ajman Free Zone, Ajman, United Arab Emirates.

By visiting or using the Services, you agree to these Terms and to our Privacy policy. If you do not agree with them, please do not use the Services. The conditions that apply to purchases themselves are set out in our Terms of sale, our Returns and refunds policy and our Shipping policy, which form part of these Terms.

1. Access and account

By accepting these Terms you confirm that you are at least the age of majority in your country of residence, or that you are using the Services with the consent of a parent or guardian.

You may browse without an account. To order, you will be asked for an email address and billing, payment and delivery details. You undertake that the information you give is accurate, current and complete, and that you are entitled to provide it. You are responsible for keeping your login details confidential and for everything done through your account. Tell us at once if you suspect it has been used without your authorisation. An account may not be sold, transferred or shared.

2. Our products

We take great care to describe and photograph our pieces faithfully. Colours and textures may nonetheless appear differently depending on your screen, its settings and the lighting, and fabric may vary slightly from one batch to another. Such variation is inherent in textile products and is not a defect.

Descriptions, references and availability may change at any time without notice. We may discontinue a model or limit the quantity available per customer, per region or per order.

3. Prices and payment

Prices are shown in euros (€), inclusive of all taxes applicable to deliveries within the European Union, and exclusive of any customs charges outside it. The price that applies is the one displayed at the moment your order is placed and confirmed by email. Delivery is complimentary, with tracking, to every destination offered at checkout.

Promotions and discount codes may be limited in time, in quantity and in scope, may not be combined unless we say so, and cannot be applied retroactively to an order already placed.

Payment is taken at the time of the order, through our payment provider, on a secure page. We never have access to your full card details. You warrant that you are authorised to use the payment method you choose.

Despite our care, an error in a displayed price may occur. Where a price is obviously incorrect, we may cancel the order, tell you promptly and refund you in full; you may of course confirm the order at the correct price instead.

4. Orders

Placing an order is an offer to buy. The contract is formed when we confirm acceptance by email. We may decline an order — for example where an item is out of stock, where payment is refused, where the delivery address cannot be served, where we suspect fraud, or where the quantity suggests a purchase for resale. If we decline, change or cancel an order, we will contact you using the email address, postal address or telephone number you gave us, and refund any sum already taken.

Items are sold for your personal use. Purchase for commercial resale or for export as a business is not permitted without our written agreement.

5. Shipping and delivery

Delivery times are given in good faith as estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs processing, extreme weather, strikes or other events beyond our control — but we will always help you trace a parcel. 6. Returns, refunds and guarantees

Your right of withdrawal, the legal guarantee of conformity and the practical steps for returning an item are set out in our Returns and refunds policy. Nothing in these Terms reduces the rights that consumer law gives you.

7. Intellectual property

The Services and their content — texts, photographs, illustrations, videos, graphics, logos, names, page layout and the selection and arrangement of all of it — belong to Arshad Trade - F.Z.E or to its licensors, and are protected by copyright, trade mark and other intellectual property laws.

You may use the Services for your own personal, non-commercial purposes. You may not reproduce, distribute, modify, adapt, republish, download, store, transmit or exploit any part of them without our prior written consent. “Serment Couture”, our logo and our product names are our trade marks; “Shopify” and its logo are trade marks of Shopify Inc.; all other marks belong to their respective owners.

8. Reviews, photographs and other content you send us

If you send us a review, a photograph, a suggestion or any other content, you keep ownership of it and you grant us a worldwide, royalty-free, sub-licensable licence to use, reproduce, adapt, publish and display it in connection with the Services and our communications.

You confirm that the content is yours to share, that it infringes nobody’s rights, that it is not unlawful, defamatory, abusive or obscene, and that you disclose any compensation you received for it. We are not obliged to publish, keep confidential or pay for content you send, and we may remove content that breaches these Terms.

9. Relationship with Shopify

Serment Couture is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Serment Couture. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Serment Couture, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Serment Couture.

Because the Services are hosted by Shopify, Shopify collects and processes personal data relating to your access to and use of the Services in order to provide and improve them. Our Privacy policy explains this in detail.

10. Third-party tools and links

The Services may give access to tools, content or links operated by third parties, which we neither control nor monitor. They are provided “as is”, without warranty of any kind, and your use of them is at your own risk and subject to the third party’s own terms. Any complaint about a third-party product or service should be addressed to that third party.

11. Acceptable use

You may use the Services only for lawful purposes. In particular you may not: break any applicable law or regulation; infringe our rights or those of others; harass, defame or intimidate anyone; transmit false or misleading information; send spam or unsolicited advertising; impersonate another person; upload viruses or malicious code; collect or track other people’s personal data; use robots, scrapers, extraction tools or automated agents to access the Services; or circumvent our security measures, rate limits or robot exclusion headers.

Automated agents must identify themselves as such in the user-agent string of every request, must not imitate human behaviour in order to pass as a person, must not solve or bypass CAPTCHAs and similar checks, and must answer truthfully when asked whether they are software. We may restrict or block any automated access.

We may suspend or close your account, without notice, if we reasonably believe you have broken these rules.

12. Availability and accuracy

We do our best to keep the Services available and accurate, but we do not guarantee uninterrupted or error-free operation. Information published on the site may occasionally contain typographical errors or inaccuracies as to descriptions, prices, promotions, shipping charges, transit times or availability. We may correct such errors and update or cancel affected orders at any time, including after an order has been submitted, and we will refund you in full in that case.

13. Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that may not lawfully be excluded — in particular the rights of consumers under mandatory consumer protection law.

Subject to that, we are not liable for indirect or consequential loss — including loss of profit, of revenue, of opportunity or of data — arising from the use of the Services, and our total liability in connection with an order is limited to the amount you paid for that order.

We are not liable for a failure to perform caused by an event beyond our reasonable control, including natural disaster, epidemic, war, strike, carrier failure, customs blockage, or failure of a telecommunications or hosting provider.

14. Indemnity

You agree to hold us, Shopify and our respective affiliates harmless from any claim, loss or reasonable legal cost arising from your breach of these Terms, your breach of the law or of a third party’s rights, or your use of the Services. This does not apply to consumers to the extent that applicable consumer law prohibits it.

15. Term and termination

These Terms apply for as long as you use the Services. We may suspend or end your access at any time where you breach them, and you will remain liable for any sum owed up to that date. The clauses on intellectual property, content you send us, liability, indemnity, governing law and any clause which by its nature should survive, continue to apply after termination.

16. If a clause is invalid

If any provision of these Terms is held unlawful, void or unenforceable, it shall be applied to the fullest extent permitted and, failing that, severed; the remaining provisions continue in force. Our failure to enforce a provision is not a waiver of it.

17. Assignment

You may not transfer or assign your rights or obligations under these Terms without our written consent. We may transfer ours, for example in the event of a reorganisation or a sale of the business, without this affecting your rights.

18. Governing law and disputes

These Terms are governed by the law of the United Arab Emirates as applicable in the Emirate of Ajman. If you are a consumer resident in the European Union, the European Economic Area or the United Kingdom, this choice of law does not deprive you of the protection of the mandatory rules of the law of your own country of residence, and you may bring proceedings before the courts of that country.

Before any dispute, please write to us: we answer within 24 hours and settle almost everything amicably. Consumers in the EU can also obtain free guidance from the European Consumer Centre of their country of residence (eccnet.eu).

19. Changes to these Terms

The current version is always available on this page. We may update these Terms; the version that applies to your purchase is the one in force on the day your order is placed. Where a change is significant, we will tell you and give you notice as the law requires.
