These Terms of sale govern every purchase made on sermentcouture.com. They are accepted at checkout, before payment. We recommend that you save or print a copy.

Article 1 — The seller

Article 2 — Scope

These Terms apply to consumers, meaning natural persons acting for purposes outside their trade, business or profession. They set out the rights and obligations of each party for the sale of bridal gowns and accessories online. They prevail over any other document, and the version that applies is the one in force on the day the order is placed.

Article 3 — Products

The essential characteristics of each item — composition, cut, available sizes, colour, care instructions — are set out on its product page. Photographs are as faithful as possible but are not contractual: slight variation in shade or in the placement of lace, embroidery or beading is inherent in these products.

Offers are valid for as long as they are displayed on the site and while stocks last. Where a gown is produced from measurements you supply, we confirm those measurements in writing before production starts; once production has begun they can no longer be changed.

Article 4 — Prices

Prices are stated in euros (€), inclusive of all taxes applicable to deliveries within the European Union. Delivery is complimentary worldwide. Outside the European Union, customs duties and import taxes may be charged by the carrier on delivery and are payable by the recipient.

We may change our prices at any time; the price charged is always the one displayed at the time the order is placed.

Article 5 — Placing an order

  1. You select your items, your size and, where applicable, your options, and add them to the basket.
  2. You check the contents of the basket, the total price and the delivery address.
  3. You accept these Terms of sale and confirm the order — this is the point at which you undertake to pay.
  4. You pay.
  5. We send you an acknowledgement by email. The contract is formed when we confirm acceptance of the order.

Before confirming, you can correct any mistake at each step by returning to the previous screen. Please check your details carefully, in particular the delivery address: we cannot be held responsible for an address entered incorrectly.

We may refuse an order where an item is unavailable, where payment is refused or irregular, where a previous order remains unpaid, where the address cannot be served, or where the order is manifestly abnormal or made in bad faith.

Article 6 — Payment

Payment is due in full at the time of the order. We accept the payment methods displayed at checkout. Transactions are processed by our payment provider on a secure page; your card details are transmitted encrypted and are never stored by us.

Your order is only processed once payment has been authorised. If your bank refuses the payment, the order is automatically cancelled.

Article 7 — Delivery

We deliver worldwide to the address you give at the time of the order. Preparation takes two to four weeks for a gown and three to seven working days for accessories ordered alone; transit is added to this. A tracking link is sent by email on dispatch.

Delivery times are estimates. Where delivery is significantly late, write to us: if we still have not delivered within a further reasonable period that you set us, you may cancel the order and we will refund all sums paid, within 14 days of that cancellation.

Risk passes to you when the goods are physically delivered to you or to the person you designate. Please check the parcel on arrival and note any damage on the carrier’s document.

Article 8 — Right of withdrawal

Consumers in the European Union, the EEA and the United Kingdom have 14 days from receipt of the goods to withdraw from the contract without giving a reason and without penalty, except for the cost of returning the goods.

The right of withdrawal does not apply to goods made to the consumer’s own measurements or otherwise clearly personalised, nor to sealed goods unsuitable for return for reasons of hygiene once unsealed.

Article 9 — Legal guarantees

All our products benefit from the legal guarantees provided by law, independently of any commercial guarantee:

  • the legal guarantee of conformity, for two years from delivery, under which we must deliver goods that conform to the contract and remedy any lack of conformity by repair or replacement, failing which by a price reduction or termination of the contract (Directive (EU) 2019/771; in France, art. L.217-3 et seq. of the Code de la consommation);
  • the guarantee against hidden defects, allowing the sale to be rescinded or the price reduced (in France, art. 1641 et seq. of the Code civil).

To make a claim under either guarantee, write to sermentcouture@outlook.com with your order number and photographs. Shipping costs relating to a claim under the guarantees are borne by us.

Article 10 — Sizes and alterations

Each product page carries a size guide. If you are between two sizes, or unsure, write to us before ordering — we advise you in writing, free of charge. Where a gown is bought in a standard size, minor alterations by your own seamstress are normal and are not covered by the guarantees, which cover defects and non-conformity rather than personal fit.

Article 11 — Liability

We are liable for the proper performance of the contract. We are not liable where a failure is attributable to you, to an unforeseeable and insurmountable act of a third party, or to an event of force majeure. Our liability towards a consumer is never limited below what the law provides.

Article 12 — Personal data

The data collected in the course of an order is necessary to process it and is handled in accordance with our Privacy policy. You have rights of access, correction, erasure, portability, restriction and objection, exercisable at sermentcouture@outlook.com.

Article 13 — Complaints and disputes

For any complaint, write to sermentcouture@outlook.com or message us on WhatsApp at +33 7 56 86 19 33. We answer in writing within 24 hours, seven days a week.

Consumers in the European Union can obtain free guidance from the European Consumer Centre of their country of residence (eccnet.eu).

Article 14 — Governing law

These Terms of sale are governed by the law of the United Arab Emirates as applicable in the Emirate of Ajman. If you are a consumer resident in the European Union, the EEA or the United Kingdom, this choice does not deprive you of the protection of the mandatory rules of your own country of residence, and you may bring proceedings before the courts of that country.

Orders and invoices are archived on a reliable and durable medium. You may obtain a copy of any document relating to your order by writing to us.
